Privacy Policy

This Privacy Policy explains how AdsTalent (“AdsTalent,” “we,” “us,” or “our”) collects, uses, discloses, and protects information about visitors to and users of adstalent.co and any sites, applications, or services that link to this Policy (collectively, the “Site”). It also describes your choices about how we handle your information and the rights you have under U.S. state privacy laws, the European Union’s General Data Protection Regulation (GDPR), and the United Kingdom’s data protection framework.

By using the Site, you acknowledge you have read this Policy. If you do not agree with our practices, do not use the Site.

Who We Are

AdsTalent is a marketing agency operating from 999 W Main Street, Suite 100, Boise, ID 83702, United States. We are the “data controller” for the personal information we collect through the Site under GDPR terminology, and the “business” that collects your information under California terminology.

Information We Collect

We collect the following categories of information.

Information you provide directly

Identifiers and contact details. Your name, email address, phone number, business name, business website, and any information you include when you submit a form, schedule a call, apply for a job, or email us.
Job applications. If you apply through the Careers section, we collect your resume file, work history, references, and any information you provide in cover letters or application questions.
Content of communications. The substance of messages you send us, notes we make during calls or engagements, and any files you share.
Payment and billing details. If you become a client, we may collect billing address, tax identifier, and payment method details. Payment processing is handled by third-party processors; we do not store full card numbers on our own systems.

Information collected automatically

Device and connection data. IP address, browser type and version, operating system, device identifiers, referring URL, pages viewed on the Site, time and duration of visits, links clicked, and general geographic location inferred from IP.
Cookie and similar technology data. See the Cookie Policy for a full list of cookies, pixels, and local storage entries used on the Site, their vendors, purposes, and lifetimes.
Analytics and advertising measurement. Aggregate site usage patterns, campaign response data, and conversion events. When you have granted the corresponding consent, these signals are transmitted to Google Analytics 4 and Google Ads for measurement.
Chat interactions. If you use the on-page chat widget, the widget provider processes the content of the conversation and metadata about it. Chat only loads after you grant Marketing consent.

Information from third parties

Publicly available business information. During a sales conversation or engagement, we may look up public information about your business from sources such as your website, LinkedIn, Google Business Profile, review platforms, and industry directories.
Referrals. If a partner or existing client refers you to us, we may receive your name and contact information from them.

How We Use Information

We use the information described above for the following purposes:

To respond to your inquiries, schedule meetings, and provide the services you request.
To evaluate job applications and communicate with candidates.
To operate, maintain, secure, and improve the Site and our services.
To measure the performance of the Site and our marketing campaigns using consented analytics and advertising tools.
To send you information about our services when you have opted in or when it is a follow-up to a conversation you started.
To detect, investigate, and prevent fraud, security incidents, and violations of our terms.
To comply with our legal, tax, accounting, and regulatory obligations.
To enforce our contracts and other legal rights.

Legal Basis for Processing (EEA and UK visitors)

If you are located in the European Economic Area or the United Kingdom, we process your personal data on the following legal bases:

Consent. For non-essential cookies, marketing communications you have opted into, and any processing you have explicitly agreed to. You may withdraw consent at any time.
Contractual necessity. To provide services you have requested and to prepare a contract with you.
Legitimate interests. To operate and improve the Site, secure our systems, prevent fraud, and communicate with business contacts, provided those interests are not overridden by your rights.
Legal obligation. Where we are required to process information to comply with a legal or regulatory obligation.

How We Share Information

We share information only in the following situations:

Service providers. Vendors that operate infrastructure and tools on our behalf, listed in the “Third-Party Services” section below. These vendors process information only under written contract and only for the purposes we specify.
Professional advisors. Lawyers, accountants, insurers, and auditors when necessary to obtain professional advice or comply with a legal obligation.
Legal and safety. When we reasonably believe disclosure is required to comply with a subpoena, court order, regulatory request, or applicable law; to protect the safety of any person; to enforce our rights; or to investigate suspected fraud or abuse.
Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, we may transfer information to the acquiring or successor party, subject to the same privacy commitments.
With your direction. When you ask us to share your information with a specific third party.

We do not sell your personal information for money. We may share limited identifiers (such as hashed email addresses or cookie identifiers) with advertising platforms for measurement and audience purposes when you have granted Marketing consent. Under California’s expanded definition of “sale” and “sharing,” those disclosures may be considered a sale or share; you can opt out at any time on our Do Not Sell or Share My Personal Information page.

Third-Party Services

The Site relies on the following third-party services. Each vendor operates under its own privacy policy, which we recommend you review.

Google Analytics 4 (Google LLC). Aggregate site analytics. Cookies set: _ga, _ga_<property>. Loaded only after Analytics consent.
Google Ads (Google LLC). Advertising measurement and conversion tracking. Cookies set: _gcl_au, _gcl_aw, _gcl_dc. Loaded only after Marketing consent.
Google Cloud Platform (Google LLC). Hosting via Cloud Run. Google processes server logs for security and operations.
Google Firestore and Cloud Storage (Google LLC). Storage of job applications and resume files submitted through the Careers section.
Cloudflare, Inc. DNS resolution for adstalent.co.
Cadrey (Cadrey AI, Inc.). On-page chat widget. When you use the chat, Cadrey processes the conversation and associated metadata. Loaded only after Marketing consent.
OneCal (OneCal.io). Booking of consultation calls. When you schedule, OneCal processes your name, email, calendar preferences, and any notes you add.

Cookies and Tracking Technologies

We use cookies and similar technologies (pixels, local storage) to run the Site, understand how it is used, and support advertising. A full description, including the categories, the specific cookies in each category, their vendors, and their retention periods, is on our Cookie Policy page.

You choose which categories run on your device. Necessary cookies are always on because the Site cannot function without them. For visitors in the European Economic Area, the United Kingdom, Switzerland, or where a Global Privacy Control browser signal is present, Analytics and Marketing cookies are off by default and only run after you affirmatively opt in. For visitors elsewhere, including the United States, Analytics and Marketing cookies run under an opt-out model: they may fire on first visit, and you can turn them off at any time using the cookie preferences panel or the “Do Not Sell or Share My Personal Information” link.

Data Retention

We retain personal information only as long as necessary for the purposes described in this Policy, including:

Inquiry records: Up to 24 months from last contact, then deleted unless a business relationship has begun.
Client records: For the duration of the engagement plus 7 years for tax, accounting, and legal compliance.
Job applications: 12 months after the position is filled or closed, unless you request earlier deletion.
Analytics data: Google Analytics 4 is configured with a 14-month event data retention.
Server and security logs: Up to 90 days.

Data Security

We use administrative, technical, and physical safeguards designed to protect information against loss, unauthorized access, disclosure, alteration, or destruction. Traffic to and from the Site is encrypted with TLS. Access to backend systems is restricted, logged, and reviewed. No system is perfectly secure, and we cannot guarantee absolute security, but we take practical steps to make an incident unlikely and to contain it quickly if one occurs.

Your Rights

Depending on where you live, you may have some or all of the following rights with respect to the personal information we hold about you:

Right to know or access. You can request a copy of the personal information we have collected about you, the categories of sources, the purposes for which we use it, and the categories of third parties with which we share it.
Right to correct. You can request that we correct inaccurate information about you.
Right to delete. You can request that we delete personal information about you, subject to legal exceptions (for example, information we are required to retain for tax purposes).
Right to portability. You can request a copy of your personal information in a portable, machine-readable format.
Right to opt out of sale or sharing. You can direct us not to sell or share your personal information with third parties for cross-context behavioral advertising. Use our Do Not Sell or Share My Personal Information page or turn off Marketing cookies.
Right to limit sensitive information. You can direct us to limit our use and disclosure of sensitive personal information. We do not currently use sensitive personal information for purposes that trigger this right.
Right to non-discrimination. We will not deny you goods or services, charge you different prices, or provide a different level of quality because you exercised any of these rights.
Right to withdraw consent. Where processing is based on consent, you can withdraw it at any time.
Right to lodge a complaint. You may file a complaint with the applicable data protection authority.

To exercise any of these rights, email [email protected] with the subject line “Privacy Request.” We will verify your identity before responding, typically by asking you to confirm information we already have on file. Requests are answered within 45 days; complex requests may take up to 90 days, in which case we will notify you of the extension.

Notice to California Residents

If you are a California resident, you have the rights listed above under the California Consumer Privacy Act as amended by the California Privacy Rights Act (collectively, “CCPA”). The categories of personal information we collect, the sources, the purposes, and the categories of third parties with whom we share the information are described in the sections above.

In the last 12 months, we have collected the following categories of personal information as defined by the CCPA: identifiers (name, email, phone, IP address, cookie identifiers); commercial information (services requested, business interactions); internet or network activity (browsing behavior on the Site, click history); geolocation data (general location from IP); professional or employment information (from job applicants); and audio or electronic information (recorded calls or voicemails, chat transcripts). We do not collect biometric information, precise geolocation, government identifiers, or protected classification characteristics.

In the last 12 months, we have disclosed identifiers, commercial information, internet activity, and geolocation to the third-party service providers listed in the “Third-Party Services” section for business purposes such as analytics and advertising. As explained above, some of those disclosures may qualify as “sale” or “sharing” under the CCPA definitions. You can opt out on our Do Not Sell or Share page.

You may designate an authorized agent to make requests on your behalf by providing signed permission and verification of your identity.

Notice to Other U.S. State Residents

Residents of Colorado, Connecticut, Utah, Virginia, Texas, Oregon, and other states with comprehensive privacy laws have rights similar to the CCPA rights described above, including the right to access, correct, delete, obtain a copy of, and opt out of the sale of, targeted advertising based on, or profiling based on personal information. Use the same email address to submit requests.

Notice to EEA and UK Residents

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the rights described above under GDPR and equivalent UK law. Our lawful bases for processing are described in “Legal Basis for Processing.” If our processing is based on consent, you may withdraw that consent at any time without affecting the lawfulness of processing that occurred before withdrawal. You may lodge a complaint with your local supervisory authority; contacts are listed on the European Data Protection Board website.

We do not have an EU representative appointed at this time because our processing of EEA visitors is occasional and does not require appointment under Article 27(2) GDPR. Direct any privacy inquiry to [email protected].

When information about EEA, UK, or Swiss visitors is transferred to service providers in the United States or other jurisdictions outside the European Economic Area, we rely on Standard Contractual Clauses or, where applicable, the EU-U.S. Data Privacy Framework and its UK and Swiss extensions, as our transfer mechanism.

Children’s Privacy

The Site is not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe your child has provided personal information to us, contact [email protected] and we will delete it.

Do Not Track

Some browsers offer a “Do Not Track” signal. There is no widely accepted standard for interpreting these signals, and we do not currently respond to them. You can still control tracking through our cookie banner, the Do Not Sell or Share page, and your browser and device settings.

Third-Party Links

The Site may link to third-party websites or resources we do not control. This Policy does not apply to those sites, and we are not responsible for their content or privacy practices. Review the privacy policies of any third-party sites you visit.

Changes to This Policy

We may update this Policy from time to time. When we do, we will change the “Effective” date at the top of this page. Material changes will be highlighted with a notice on the Site for at least 30 days. Continued use of the Site after the effective date of an update means you accept the revised Policy.
